Terms of Use
These terms govern your access to and use of Captivate Exam Hub. By creating an account or using the service, you agree to them.

1. Who we are
Captivate Exam Hub (the “Service”) is operated by JEK Industries Pty Ltd (ABN 66 105 223 501) (“we”, “us”, “our”). You can contact us at contact@captivateexamhub.com.au.
The Service provides direct-to-student exam-revision support, including practice questions, flashcards, study suggestions, feedback and progress tracking. Some of this content is generated using artificial intelligence — see our AI Use & Accuracy notice.
2. Educational purpose only
The Service offers general study support. It is not a substitute for teacher instruction, tutoring, or official assessment advice from your school or the relevant exam authority. It does not provide legal, psychological, medical, careers, disability or other professional advice. Any wellbeing or study-strategy content is general information only — seek appropriate professional help where needed.
We do not guarantee any particular learning outcome, mark, ranking or exam result. Your results depend on many factors outside our control.
3. Eligibility and accounts
- You must provide accurate registration details and keep your login credentials secure. You are responsible for activity under your account.
- The Service is intended for school-age students and may be used by people under 18. If you are under 18, you must have permission from a parent or guardian to use it — see Students Under 18.
- We may suspend or close accounts that breach these terms or our Acceptable Use policy.
4. Acceptable use
Your use of the Service is subject to our Acceptable Use policy, including academic-integrity expectations. Do not misuse, copy, scrape, resell or attempt to disrupt the Service.
5. Intellectual property
The Service and its content — including question banks, explanations, summaries, software, branding and design — are owned by us or our licensors and are protected by copyright and other laws. See our Copyright Notice for what you may and may not reuse. We grant you a personal, non-exclusive, non-transferable licence to use the Service for your own study.
6. Content you provide
You may enter answers, notes and other content. You keep ownership of what you submit, and you grant us a licence to process it to operate and improve the Service as described in our Privacy Policy. Do not submit content you do not have the right to share, and do not enter sensitive personal information into AI prompts.
7. Third-party services
The Service relies on third parties (for example, our hosting and authentication provider and our AI provider). Their handling of data is described in our Privacy Policy. We are not responsible for third-party websites you reach through links from the Service.
8. Subscriptions, pricing and cancellation
Some features require a paid subscription. Pricing is per subject: A$7 per subject each month, capped at A$17.99 per month for 3–6 subjects, plus A$7 per month for each additional subject beyond six. All prices are in Australian dollars and include GST.
- Free trial. New accounts may start a 3-day free trial. No payment method is required to begin the trial. When the trial ends, access to paid features stops unless you choose to subscribe — we do not automatically charge you at the end of a trial.
- Billing and renewal. Paid subscriptions are billed monthly in advance and renew automatically each month until you cancel. Adding a subject part-way through a month is charged on a pro-rata basis.
- Cancel anytime. You can cancel at any time from your account. Cancellation takes effect at the end of your current paid month; you keep access until then and are not charged again.
- Subject selection lock. When you select a subject, it is locked to your account for the remainder of that calendar year (until 31 December). You may add subjects at any time, but you cannot swap a selected subject for a different one until selections reset on 1 January. Dropping a subject or cancelling stops billing for it but does not free the locked selection for substitution before the reset.
- AI credits. Paid subscriptions include a monthly allowance of AI credits (shown at purchase and on your account page) that resets on the first of each month and does not roll over. A daily usage cap applies to keep the service available for everyone. You can also buy one-off credit packs; purchased credits are used only after your included monthly credits, expire 3 years from purchase (the expiry date is shown before you buy and on your account page), are non-transferable and non-refundable except as required by law. We may adjust the included credit allowance from time to time with reasonable notice; purchased packs keep the credits you bought.
- Price changes. We may change prices from time to time. We will give reasonable notice of changes affecting an active subscription, and changes will not apply to a month you have already paid for.
Nothing in this section limits your rights under the Australian Consumer Law (see below), including any right to a remedy where a consumer guarantee is not met.
9. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded. Where the ACL applies and the Service is not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to comply with a consumer guarantee is limited (to the extent permitted) to re-supplying the service or paying the cost of re-supply.
10. Disclaimers and limitation of liability
To the maximum extent permitted by law and subject to the ACL, the Service is provided “as is”. We do not warrant that content is accurate, complete, current or error-free, or that the Service will be uninterrupted. To the extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of, or reliance on, the Service.
11. Changes
We may update these terms from time to time. We will change the “last updated” date above and, for material changes, take reasonable steps to notify you. Continued use after changes means you accept the updated terms.
12. Governing law
These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia.
